Accused pedophile takes a plea: co-defendant has trial in January

FORT WAYNE, Ind. ---The victim will get a copy of his molester’s plea agreement.
Court documents obtained by The Probable Cause indicate that Dylan Kieres, one of two accused of having sex with a 14-year-old boy, will serve three years in prison, if the judge agrees.
To call it sexual misconduct with a minor is a stretch when these two - the other perpetrator, Charles McDaniel - are considered part of a predatory ring of men who wear “pup” masks as part of their ritual, a human trafficking investigator told The Probable Cause.
The leather masks, which make them look like dogs, conceal their faces, although in Kieres’ online photo he still wears his tell tale eyeglasses.
Their singularly disturbing photos on Facebook are proof of this frankly revolting conduct where grown men seek underage boys for sex, according to the investigator. Court documents indicate that Kieres and Charles McDaniel, 43, filmed these encounters.
The victim who remains anonymous, but spoke freely to The Probable Cause, confirmed the online activities and recruitment through chat rooms.
In December, Fort Wayne police got a tip that McDaniel was Kieres’ roommate and he was a known pedophile.
When the dragnet started to close in, Kieres, 33, contacted police to talk about what was going on at his apartment on St. Marys Avenue.
On May 18, Kieres posted on his Facebook page that McDaniel had a warrant and he was a known pedophile, perhaps to distance himself from him, although he was engaging in the same conduct, court documents say.
It was Kieres who recruited the victim who will now be notified of the plea agreement. They met at a downtown Fort Wayne Pride event about six years ago when the victim was 14 and searching for the comfort of a like community, the victim told The Probable Cause.
But enough of this. Kieres, through his attorney, David Joley, pleaded guilty to possession of child pornography, a Level 5 felony and child exploitation, also a Level 5 felony. The sentence for a Level 5 in Indiana is between one and six years with a three-year advisory.
The two Level 5 felonies - nothing to do with the sexual misconduct which was a Level 4- were lumped together as a concurrent sentence which means Kieres will serve those sentences at the same time, not one after the other as in a consecutive sentence. He will then serve three years on probation.
In exchange for this lighter sentence, Kieres signed the agreement and waives his right to a trial. His sentencing is and can be deferred so that he can “testify truthfully in any cases,” i.e. the heftier case against McDaniel.
For the moment, McDaniel faces a jury trial in late January. His charges include child rape.

The victim who claimed he had sex with Kieres multiple times until he realized how much older Kieres was and found him creepy, probably knows that the real punishment comes with fair warning: child molesters are not welcome in prison.
Conventional wisdom says they get their just metes there, if the guards agree to look the other way.
Likely, he will spend his three or fewer years at the New Castle Correctional Facility. Those in the know say that’s where they go.
